Terms of service

These are the terms covering use of AVA AI (the SMS receptionist) and BookBase (the booking system). They’re short on purpose.

1. The deal

You pay the monthly subscription fee. We provide the software and the support level described on the pricing page. You can cancel any time in the customer portal.

2. Founding-10 rate

If you’re one of the first 10 paid subscribers, your monthly rate is locked at $150 AUD for as long as your subscription stays continuously active. If you cancel and re-subscribe later, you re-enter at the then-current standard rate.

3. What you can’t do

  • Use AVA to send unsolicited SMS marketing in violation of Australian Spam Act rules.
  • Use AVA to impersonate a person, professional, or service you’re not.
  • Resell access to AVA or BookBase as a white-labelled product without an agreement.

4. Service availability

We aim for 99.9% uptime. If AVA is down for an hour or more in a calendar month, founding members get an automatic two-week credit. We post incidents to our status page.

5. Liability

We’re not liable for indirect or consequential losses (e.g. a missed booking, a customer who didn’t come back). Direct liability is capped at the fees you’ve paid us in the prior 12 months. This is standard for SaaS and required by our insurance.

6. Termination

You can cancel any time in the Stripe customer portal. We can terminate accounts that violate section 3 with 30 days notice (or immediately for serious misuse).

7. Governing law

These terms are governed by the laws of Queensland, Australia. Any dispute is resolved in Brisbane courts.
